Ricky, el primer paso - Ricky, the first step
Ricky looks in the coming days to withdraw the lawsuit brought against Joventut Villacampa reiterates that it is a basic condition for opening a dialogue process
(Ed Note: Full Spanish article below the fold. Muchas gracias to miguelsp for all of these links. As always, if anyone has a translation, please leave it in the comments. Remember, Joventut has said that it would not negotiate with Rubio with a lawsuit hanging over its head. Is this a surrender on Rubio's part or the beginning of negotiations on the buyout payment schedule? What say you?)

Ricky surrenders
“Now I have plenty of options to return to the ACB League,” said the base that night and his return to Barcelona confirmed. “In talking to see if Penya one because it is not as serious as people think,” he said on Monday. Now, Ricky and their environment and have it clear at all. Fegan has been in United States thinking about the future and the player wants to go one or two more seasons in Badalona. Want to negotiate with DKV Joventut. The move was postponed to the NBA, there is no possibility of going to another European team, the clause is not depreciable player to have a couple of years and the contract remains in force with Penya. Ricky, then surrenders.

The most interesting, non-speculative part of the article translated below:
-—
To get there [playing for Joventut for one more year], the path is complicated. First, because the relationship with the team and possibly with most of the fans of the team is strained, and second, because both parties would have to reach an agreement, something which, right now, doesn’t seem easy.
It’s probably, however, that both parties are condemned to understand each other and find a way to work together. For now, all indications point to the first step coming from Rubio’s lawyers. Rubio, in recent days, has said, “I haven’t done anything wrong. The suit is just to see if the clause is correct,” and has reaffirmed that if he doesn’t go to the NBA, he’ll stay with Joventut."

Ricky looks in the coming days to withdraw the lawsuit brought against Joventut
Villacampa reiterates that it is a basic condition for opening a dialogue process Jesús Pérez Ramos – 02/07/2009 03:00
Lawyers representing Ricky Rubio are seriously considering withdrawing the demand that the player began his day on his current club, DKV Joventut, for, as the words of the young base, whether your clause is unreasonable with respect to their wages. This movement could occur in the coming days, said yesterday according to a source close to the player, it is towards a consideration in any negotiation, it would be a gesture to try to make the relations between the two sides back to ground some warmth.
For its part, Jordi Villacampa, president of the green, said that yesterday afternoon, no one had reported the intention to withdraw the application and reiterated that the movement by the player is a basic condition for opening a dialogue process . The leader of the club badalona denied that it had kept any meeting with any representative of the player from the day of the draft and added that time was unaware of what the intentions of the other party.
The truth is that the status of Ricky Rubio is so entangled that from now all parties are in a delicate situation. The player had hoped to stop this summer in the NBA, but his election as the number five draft-by-Minnesota Timberwolves does not give you enough to pay his salary as termination clause with DKV Joventut: 4.7 million euros as of yesterday, on July 1, until next June, as contained in the contract of the player, become 5.7 million.
Without the possibility of calling at New York Knicks, his dream destination, because the Timberwolves are now refusing to move very complicated and the option to go to another team in the CBA or European-operation would be economically and possibly in Sports-crazy, Ricky quedauna it out: Penya follow in another year and leave next summer to negotiate a lower amount for those 4.7 million euros that are agreed. To get to the way it is quite complicated, firstly because the wound with DKV Joventut, with the club and possibly the majority of fans of Olympic Badalona remains open-and second, because both parties would have to reach an agreement, something that does not seem easy at the moment.
It is likely, however, that both parties are ‘doomed’ to understand and seek outlets together. For now, it appears that the first step will probably come from Ricky Rubio’s lawyers, who in recent days said that "I have not done anything wrong. A complaint is a question as to whether the clause is correct and has assured that if the NBA is going to remain in the Joventut.
Shall in any event, the first step toward a détente that at the moment seems bound

same article
Is this the same article Walters is citing in his new “Rubio is staying in Spain for two years” article?

It's not the same
It is the same story but it’s not the same source. The paper Walters quoted assumed that Ricky dropping the suit meant that he is playing out his contract. This one says that is just a requirement to reopen negotiations between the two parties.
The team said several days ago that they would not do anything to renegotiate the buyout until Ricky dropped his lawsuit. Now that he is, the buyout can move forward hopefully.

In dropping the lawsuit
It leaves open the possibility of re-negotiating the buyout.
Joventut didn’t want to be sued, because (1) they may lose and have the buyout signifcantly reduced and (2) Rubio wouldn’t be able to suit up.
This is still Rubio’s best chance of coming this summer, although that is really a slim chance anyway. If the suit had enter the Spanish courts in October, who know how long it takes and the major players lose some control in regards to timing.

Personally
I’ve read more than a few times (by Spanish fans) that Rubio and his team are in a bit of a standoff. It benefits Joventut more to have Rubio pay a buyout which will give them replacement players at some point.
As opposed to Ricky playing there, and Joventut losing that level of buyout money that Ricky could realistically pay at some point.
I think Rubio, and his “team” are trying to play that very need of Joventut against them. Do you want a reduced buyout that makes us happy, or lose out on a lot of money (in any real sense) by not negotiating this down further and just paying him what you pay him the next 2 seasons.
Ricky is in a no-lose position here. Because he went 5th in the draft, this gives him far more leverage than it would have had he gone top 3.
The beauty part is that the Wolves did protect themselves by taking Flynn (even if they thought he was BPA) in the event that Rubio does stay in Spain.
The real story here, honestly, is that Joventut over-estimated the value of Ricky Rubio in relation to the NBA.

They overstimated their ability to extract the full buyout from Rubio. And Rubio got some disgraceful advice when he signed the deal.
The Wolves have leverage over Rubio and Rubio has leverage over Joventut.

That advice was from whom?
From his father, seemingly? They signed the deal when Ricky was 14 years old.

Basic question: why can't the buyout be spread over a number of years?
Spreading the 4.7 million Euros or $6.6 million over a handful of years, rather than having it paid up front, would seemingly resolve most of the dilemma as far as Rubio’s coming over immediately. The gap between rookie scale at the #2 pick as opposed to #5, at that point, becomes much less of a hurdle.
No doubt Rubio’s people would like to reduce the amount, but it surprises me that we don’t see that possibility even mentioned in these articles.

He only has...
….a 2 year guarantee in the NBA. Granted, most rookie options are exercised but there are only 2 guaranteed years. If Rubio is 1/2 of what he is cracked up to be, he should play for a full 5 on the rookie deal with a 2nd contract of at least the mle. The problem is getting this amount insured for the first 2 years.
